Lawyers urge State Bar of Texas to suspend and disbar attorney Cindy Powell after guilty plea in Georgia election tampering case

Seventeen lawyers have sent a Nov. 6, 2023 letter to the State Bar of Texas, urging it to suspend and then disbar Texas attorney Sidney Powell for having pleaded guilty and been convicted of a misdemeanor in Georgia state court regarding her role in the 2020 presidential election.

Powell was involved in a Georgia scam to rig the election there in favor of Donald Trump. Specifically, Ms. Powell pleaded guilty that she and her co-conspirators intentionally and egregiously worked to undermine the results of the Georgia election by illegally manipulating Dominion’s voting machines, illegally accessing and stealing Dominion’s property and data, and violating voter confidentiality.

The lawyers contend that the State Bar must act accordingly under the Texas Disciplinary Rules of Professional Conduct, which require disciplinary action, the minimum being suspending her license for the six years she is on probation for the crime she admitted committing, which under the Rules is a both a “serious crime” and an “intentional crime.”

A copy of the letter is attached, authored by Chuck Herring, one of the state’s foremost authorities on lawyer ethics. The signatories include former presidents of the State Bar and other distinguished counsel.

One of the signatories, Jim Harrington, said that “the State Bar must act promptly to preserve the integrity of the legal profession, which is fundamental to the functioning of our democracy.

“Powell’s disgraceful activities, to which she has admitted and pleaded guilty, demean and denigrate the standards for which the legal profession stands. The State Bar has the compulsory duty to suspend and then disbar her.”

According to Herring, “Ms. Powell attempted to thwart the will of Georgia voters and to deny those voters the effective use of the franchise. In a democracy, few crimes are more consequential.” The letter concludes: “We ask that you pursue discipline  against Ms. Powell promptly to uphold the fundamental values and standards of our Texas legal profession, which is crucially important for the preservation of our democracy.”
